Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded via the online shop stamm-baum.at between Hans Christian Toifl e.U. (hereinafter: seller) and the customer (hereinafter: customer).

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the "Order with payment obligation" button, you submit a binding order for the products contained in the shopping cart. Confirmation of receipt of your order follows immediately after submission. The contract is only concluded when we accept your order by sending an order confirmation.

4. Prices and Shipping Costs

All prices are in euros and include the applicable statutory value-added tax plus any applicable shipping costs.

• Cuttings and seeds: 13% VAT
• Other products: 20% VAT

Shipping Costs:

• Austria: €7.00 (Free shipping from €100)
• Germany: €12.00 (Free shipping from €200)
• Other EU countries: Calculated at checkout

5. Payment Terms

Payment is made via the payment methods offered in the shop:

• Credit Card (Visa, Mastercard)
• Instant Bank Transfer
• SEPA Direct Debit

Payment processing is carried out by our payment service provider Stripe.

6. Delivery Conditions

• Delivery area: EU countries
• Standard delivery time: 2-5 working days
• Plants are only shipped from Monday to Wednesday to avoid weekend storage

The delivery time is stated in the product description. For deliveries within Austria, shipping costs of €7.00 apply. Free shipping from €100.00.

7. Retention of Title

The goods remain our property until full payment has been made.

8. Right of Withdrawal

Consumers have a 14-day right of withdrawal. Detailed information can be found in our cancellation policy.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to contracts for:

• Sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery
• Goods that are manufactured according to customer specifications or clearly tailored to personal needs
• Delivery of live plants that are subject to seasonal availability
• Sealed audio or video recordings or computer software if the seal has been removed after delivery

The statutory warranty rights apply. Warranty claims can be asserted with us by email or post.

Reporting Defects

Please report any defects immediately upon receipt of the goods.

10. Liability

Liability for slightly negligent breaches of duty is excluded unless they concern essential contractual obligations. Liability for damages from injury to life, body, or health and under the Product Liability Act remains unaffected.

12. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/odr. We are not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
